Oscar Pistorius appeal through his lawyers to stop the State prosecutors from appealing the sentence of culpable homicide handed to him has been struck out by Judge Mapisa who handed the initial sentence.
Judge Mapisa in dismissing the appeal told the court "Iam not satisfied this is the correct court to hear this application for one thing there is nothing new. I therefore rule that the application should be struck off the roll"
Judge Mapisa said the appeal should have gone to the Supreme Court as it would be a case of her reviewing her own ruling.
Oscar Pistorius was sentenced to five years imprisonment for culpable homicide in the killing of his girlfriend, Reeva Steenkamp. The state prosecutors have appealed the judgement and Oscar through his lawyers was trying to stop the appeal.
